These rules regulate the terms of the “ŠKODA OCTAVIA Prague and Mladá Boleslav Covered Drives Contest” (hereinafter referred to as “Contest”) and are the only document which regulates completely and obligatorily the rules of this contest.
Contest host and organizer
The host of the Contest is ŠKODA AUTO a.s., a joint-stock company with its registered office at tř. Václava Klementa 869, 293 01 Mladá Boleslav, Czech Republic, Company ID number 00177041, registered in the Commercial Register managed by the Metropolitan Court in Prague, section B, file number 332 (hereinafter referred to as the “Host”).
The organizer of the Contest, which provides practical steps in its organization, is Optimist Czech s.r.o. Jankovcova 1522/53, 170 00 Praha 7 Holešovice, Czech Republic.
Contest term and place, Contest periods
The Contest will be held from 08:00 AM (CET) 31. 10. 2019 to 23:59 PM (CET) 03. 11. 2019. The Contest will be held on the ŠKODA Auto Social Media profiles www.facebook.com/skoda and www.instagram.com/skodagram (hereinafter referred to as “Contest pages”) where the communication with participants is primarily conducted.
Contest participants
The Contest may be entered by any individual who has reached at least the age of 18, speaks English on an intermediate level.
By entering the Contest, the participant confirms unconditional acceptance of these rules. Each participant can register himself/herself only once and only under his/her own Instagram account whereas the Contest Host reserves a right to check this rule via technical as well as organizational means.
All persons who have participated in the preparation of this Contest, mainly persons employed by or in a similar relationship with the Host or the Organiser, are ineligible to participate in the Contest, as are any persons in a similar relationship with the participating authorized ŠKODA partner or with agencies entrusted with ensuring this Contest, their family members and persons close to them.
Contest mechanism, evaluation of winners
The task of a participant is to make photographs of the masqued all-new ŠKODA OCTAVIA fourth generation that will roam the streets of Prague and Mladá Boleslav (both in Czech Republic) on Thursday 31st of October, 2019.
The contestants need to upload and publish their photo on their Instagram profile with tag “@skodagram” and hashtag “#SKODAOCTAVIA” or their Facebook profile with hashtag “#SKODAOCTAVIA“. The winners will be selected by a jury of experts on the side of the Contest Host, based on the overall artistic impression.
The maximum number of photographs per contestant is three. By entering his/her photos into the Contest, the contestant gives ŠKODA AUTO permission to use the photos in Social Media or website communication.
The Contest Host will inform the winner via Instagram direct message or Facebook direct message within two days after the Contest ends and the winner will be asked to provide data necessary for sending of the prize or for further communication. If the winner doesn’t react, even to a message sent repeatedly by the Contest Host or doesn’t provide contact data within 24 hours after the e-mail was sent, his prize will be offered to second best photograph author, under same conditions. If the second winner doesn’t react, even to a message sent repeatedly by the Contest Host or doesn’t provide contact data within 24 hours after the e-mail was sent, his prize will expire without any compensation.

Acquisition and use of data
If a participant becomes a winner, he/she grants a consent to the Host to obtain and use participant’s portraits, written statements, photos and audio and visual recordings related to the participant and/or expressions of a personal nature obtained by the Host in connection with the hosting of the Contest and the delivery or drawing of winnings for commercial purposes in all communication media, regardless of their character and specifications, using all typical means, with their subsequent modification and with potential combination with other works and inclusion into a collective work. The participant grants the Host this consent free of charge without material, time, quantity or territorial limitations and can revoke it at any time. This consent shall also apply to third parties to whom the Host may provide such recordings at Host’s own discretion.
Other important conditions
The Host shall exclusively determine the exact specification of the winnings. The displaying of winnings in promotional materials is illustrative. To win the prize, it is necessary to meet other conditions (passport, visas etc.) and obligations of the winner and to consider properly own capability, mainly the medical one, for participation. The Host shall not be liable for any damages caused to the participant as a result of using the prize.
The participants are not entitled to demand money or other types of fulfillment as a substitution for the prize. The Host is not otherwise hereby bound to provide fulfillment to the Contest participants, and the participants shall not be entitled to any fulfillment from the Host other than that expressly specified herein. The Host isn’t responsible for the quality of prizes delivered by the third parties. It is necessary to exercise responsibility for possible defects directly at these suppliers. The Host reserves a right to change prizes at their own discretion.
A participant may be excluded from the Contest if the Host discovers or has reasonable suspicion that the participant or other persons aiding the participant have engaged in fraud in order to receive prizes or engaged in unfair conduct or conduct not based on the participant’s knowledge in accordance with the rules.
The Host shall not be liable for any failure to deliver messages or winnings. The Host shall not be liable for any mistake occurring as a result of technical or communication problems. The Host shall decide with final validity regarding any complaints or presented objections. The Host reserves a right without being required to provide compensation to shorten, postpone, suspend or cancel the event or to change or add anything to these rules unilaterally during event’s existence by notifying of such changes on the website specified above, where the valid and complete wording of the rules can also be found.
This Contest is not in any way operated, sponsored by or associated with Facebook, and Facebook is not responsible for it. The information provided during the event will not be provided to Facebook. All questions, comments or complaints regarding the application must be directed to the Host, not to Facebook.
This Contest is governed by the laws of the Czech Republic, except to the extent excluded by the applicable legislation of the participants’ countries.
